1. Acceptance of Terms

These Terms of Service (“Terms”) form a binding agreement between you and Quack Auto Budgeting App LLC(“Quack Auto Budgeting App LLC,” “we,” “us,” or “our”) governing your access to and use of the QuackAuto website and any related services we provide (collectively, the “Service”). By creating an account, subscribing, or otherwise using the Service in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy and Cookie Policy. If you do not agree to these Terms, you may not access or use the Service.

You represent that you are at least 16 years of age and, if you are under 18, that your use of the Service is permitted by a parent or legal guardian. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Description of the Service

QuackAuto is a do-it-yourself vehicle maintenance application that provides cost comparisons, repair guides, maintenance schedules, ownership-cost tracking, fuel and mileage logging, recall information. The Service generates estimates, guides, and recommendations using artificial intelligence and publicly available data, and allows you to record and track information about vehicles you own or manage.

The Service is offered in subscription tiers based on the number of vehicles you track. Certain features (such as the fleet dashboard and bulk export) are available only on higher tiers. We may add, modify, or remove features at any time, and the availability of any particular feature is not guaranteed.

3. Accounts & Registration

To use most features of the Service, you must register an account. You agree to provide accurate, current, and complete information during registration and to keep that information updated. You are solely responsible for maintaining the confidentiality and security of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

We may suspend or terminate your account if your use of the Service violates these Terms, if we reasonably believe your account is being used fraudulently or in connection with unlawful activity, or to protect the Service or other users. You may delete your account at any time through your Account page, as described below.

4. Subscriptions, Billing & Trials

Subscription plans

The Service is a paid subscription product. We offer personal and professional plans on a monthly or annual billing cycle, with pricing and vehicle limits displayed on our Pricing page. By subscribing, you authorize us to charge the then-applicable subscription fee to your payment method on a recurring basis until you cancel.

Free plan

We offer a free plan with limited features and no credit card required. Paid plans begin billing immediately upon purchase. You may cancel a paid subscription at any time as described below.

Auto-renewal & cancellation

All subscriptions auto-renew at the end of each billing cycle (monthly or annual) until you cancel. You may cancel your subscription at any time through your Account page. Cancellation stops future renewals; you retain access until the end of the period you have already paid for, and no further charges are made. You will not receive a refund for the unused portion of a billing period except where required by law.

Payment processing

Payments are processed by our payment service provider, Base44 Payments. Your payment card and billing details are collected and handled by the payment provider on its secure checkout pages and are subject to the provider’s own terms and privacy policy. We do not store your full card number on our servers. We may decline a transaction or suspend access if a payment fails, is disputed, or appears fraudulent.

Price changes

We may change our subscription fees upon reasonable notice. Any price change takes effect at the start of your next billing cycle following the notice. If you do not agree to a price change, you may cancel before the change takes effect.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Access or attempt to access another user’s data without authorization.
• Interfere with, disrupt, or overload the Service, its servers, or its infrastructure.
• Reverse engineer, decompile, or otherwise attempt to extract the source of the Service or its AI models.
• Scrape, harvest, or export bulk data from the Service for commercial purposes without our consent.
• Submit content that is unlawful, infringing, malicious, or that you do not have the right to submit.
• Use generated content to make safety-critical automotive decisions without independent verification.
• Circumvent subscription limits, paywalls, or feature restrictions.

We may take action, including account termination, if we determine in good faith that your conduct violates these Terms or harms the Service, its users, or third parties.

6. User Content & Inputs

You may submit information and materials to the Service, including vehicle details, odometer readings, repair and fuel records, mileage logs, maintenance notes, and uploaded receipt or invoice images (collectively, “User Content”). You retain ownership of your User Content. By submitting it, you grant Quack Auto Budgeting App LLC a worldwide, non-exclusive, royalty-free license to host, store, process, and display your User Content solely as needed to operate and improve the Service for you.

You are solely responsible for your User Content and for ensuring you have the rights to submit it. Uploaded receipt images may be processed by AI to extract data (such as totals, line items, or station names) and to verify repair or fuel records. You should not upload images containing sensitive personal information beyond what is necessary for the receipt.

We may use aggregated, de-identified data derived from User Content to improve our estimates, pricing models, and maintenance baselines. Such aggregated data does not identify you individually.

7. AI-Generated Content Disclaimer

The Service uses artificial intelligence to generate repair estimates, cost comparisons, maintenance schedules, repair guides, vehicle valuations, and fuel-economy figures. This content is generated from AI models and publicly available data and is provided for general informational and reference purposes only.

AI-generated content is not professional automotive advice. Estimates, parts lists, labor times, pricing, and maintenance intervals may be inaccurate, outdated, or inapplicable to your specific vehicle, location, or situation. You must independently verify all information before purchasing parts or beginning any repair. Always consult a qualified mechanic or your vehicle’s manufacturer documentation for safety-critical or complex repairs. You assume full responsibility for any repair you undertake and for any parts or services you purchase based on Service content.

Repair guides and estimates may be “frozen” after generation and refreshed on a periodic schedule, so pricing and parts information may not reflect real-time market conditions.

8. Intellectual Property

The Service, including its design, text, graphics, software, maintenance baselines, and generated content (excluding your User Content), is owned by Quack Auto Budgeting App LLC and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business use in accordance with these Terms.

You may not copy, redistribute, publish, sell, license, or create derivative works from the Service or its content without our prior written consent. Vehicle data, recall information, and similar third-party data remain the property of their respective owners and are made available subject to their own terms.

9. Disclaimers & No Warranties

THE SERVICE AND ALL CONTENT PROVIDED THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, Quack Auto Budgeting App LLC DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or that any estimate, guide, or recommendation will be accurate, complete, or suitable for your vehicle. You rely on the Service and its content entirely at your own risk.

10. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Quack Auto Budgeting App LLC, its affiliates, or their respective officers, directors, employees, or service providers be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, use, or goodwill, arising out of or related to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claim arising out of or related to the Service shall not exceed the amount you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim. This limitation applies even if any remedy fails of its essential purpose.

Some states do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Quack Auto Budgeting App LLC and its affiliates from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your User Content, your violation of these Terms, your misuse of the Service, or your reliance on Service content in performing any repair or purchase.

12. Account Deletion & Data

You may delete your account at any time from your Account page. Account deletion permanently removes your account and your associated vehicle, repair, fuel, and mileage data. This action cannot be undone. Deleting your account does not automatically cancel an active subscription; you should cancel your subscription before deleting your account to avoid further charges. 13. Third-Party Services & Links

The Service may link to or integrate with third-party services, including AI providers, vehicle-data sources (such as the National Highway Traffic Safety Administration recall database), payment processing, and mapping. We do not control and are not responsible for the content, practices, or availability of these third parties. Your use of third-party services is subject to their own terms and privacy policies.

14. Changes to These Terms

We may modify these Terms from time to time. If we make material changes, we will provide notice through the Service or by other reasonable means. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using the Service and cancel any subscription.

15. Governing Law & Disputes

These Terms and any dispute arising out of or related to them or to the Service shall be governed by the laws of the State of Connecticut, without regard to its conflict-of-laws principles. You and we agree to attempt to resolve any dispute informally first. If a dispute is not resolved informally, it shall be resolved exclusively in the state or federal courts located in the State of Connecticut, and you consent to the personal jurisdiction of those courts.

If you are a consumer, nothing in these Terms limits any rights you may have under applicable consumer protection laws that cannot be waived by contract.
